Terms of use

1. About these terms

These terms apply to your use of the CloakDots app for iPhone and Android.

CloakDots is provided by Digital Commerce Guild, a sole proprietorship (eenmanszaak) established in the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 94972036, with its address at Vlierweg 12, 1032 LG Amsterdam, The Netherlands. In these terms, "we" and "us" mean Digital Commerce Guild. Contact details are in section 16.

CloakDots is free. There is no account. By installing or using the app, you agree to these terms. If you do not agree, please do not use the app.

You may use CloakDots if you are 16 or older. If you are younger, please use it only with the permission of a parent or guardian.

2. What CloakDots does

CloakDots listens on your phone for signals that nearby devices broadcast over Bluetooth. It compares them with a set of device-recognition rules and shows you the category of device it recognises, such as smart glasses or other wearable devices, with a zone (Immediate, Nearby, Wider or Extended) and how sure it is. It keeps a short history on your phone, shows patterns in Insights, and can notify you when something changes.

The recognition rules are updated from app.cloakdots.com. Everything the app finds stays on your phone. How we handle personal data is described in the privacy policy at app.cloakdots.com/privacy/.

3. What CloakDots can and can't know

CloakDots can only see devices that broadcast over Bluetooth. Many devices stay silent, or broadcast only when they switch on or pair, and some cameras don't use Bluetooth at all. CloakDots can't tell whether a camera is recording, what it captures, or exactly how far away a device is. When CloakDots isn't sure, it says so.

4. No guarantee

CloakDots is an awareness tool. It is not a security product or a surveillance-detection product. We do not guarantee that CloakDots will find every device, every camera or any recording, and a result showing no devices does not mean there is no camera nearby. Please do not rely on CloakDots alone for your safety. If you believe you are being recorded unlawfully, contact the person responsible for the place you are in, or the police.

5. Your licence to use the app

We give you a personal, non-exclusive, non-transferable licence to install and use CloakDots on devices you own or control, for your own non-commercial use, for as long as you follow these terms.

You may not copy, sell, rent or distribute the app, or decompile or reverse-engineer it, except where the law allows you to do so.

The app contains third-party components, such as fonts, under their own licences. They are listed in the app under You → About.

6. Using CloakDots responsibly

Please use CloakDots in a way that respects other people. You agree not to use it:

  • to track, identify, follow, confront or harass anyone;
  • to interfere with or connect to other people's devices;
  • in breach of the law where you are;
  • where downloading or using it is prohibited by sanctions or export-control laws that apply to you or to us.

A result in CloakDots describes a type of device nearby. It is not proof that a particular person has a camera, or that a recording is being made.

7. Updates and changes to the app

We may update the app and its device-recognition rules to improve recognition, fix problems or follow the law. Updates can add, change or remove features. We will not remove features you rely on without good reason, and we will tell you about important changes in the app or in a release note.

8. Privacy

Our privacy policy explains what data the app handles on your phone and the little that reaches us. You can read it at app.cloakdots.com/privacy/.

9. Our names and logos

The CloakDots® name, the CloakDots logos and the app's design belong to their owners. These terms do not give you any right to use them, except to use the app as described here.

10. Liability

We provide CloakDots with care, but free of charge and without any guarantee that it will always work, be available or be free of errors.

As far as the law allows, we are not liable for any damage that results from using CloakDots, or from being unable to use it, including damage from relying on a result, or on the absence of a result.

This does not limit our liability:

  • for damage caused by our intent or gross negligence;
  • for death or personal injury caused by our negligence;
  • where the law does not allow liability to be limited;
  • for any rights you have as a consumer that cannot be waived by contract, including your rights if the app does not conform to what was agreed.

11. App Store and Google Play

These terms are between you and us. Apple and Google are not parties to them, and they are not responsible for the app, its content or its support. The terms of the App Store or Google Play also apply to your download and use of the app. If you downloaded CloakDots from the App Store, Apple and its subsidiaries may enforce these terms against you as third-party beneficiaries.

12. Ending use

You can stop using CloakDots at any time by deleting the app. Deleting the app removes everything it saved on your phone.

We may stop offering CloakDots or its rule updates. Where we can, we will tell you in advance in the app. If rule updates stop, the app keeps using the last rules it downloaded.

We may end your right to use the app if you seriously break section 6.

13. Transfer to a successor

We may transfer these terms, and our rights and obligations under them, to a company that continues CloakDots, such as CloakDots B.V. The transfer will not reduce your rights under these terms or under the law. We will tell you about the transfer in advance, with a notice in the app or a release note. If you do not want to continue, you can stop using CloakDots and delete the app at any time.

14. Changes to these terms

When we change these terms, we publish the new version on this page with a new version number and effective date. Earlier versions stay available at app.cloakdots.com/terms/versions/. We will tell you about important changes in the app before they take effect. If you do not agree with a change, you can stop using CloakDots and delete the app.

15. Law and disputes

These terms are governed by the laws of the Netherlands. If you are a consumer, you keep the rights that the mandatory laws of the country where you live give you.

Disputes go to the competent court in Amsterdam, the Netherlands. If you are a consumer, you may also bring a claim in the courts of the country where you live, and we can only bring a claim against you there.

If any part of these terms is invalid, the rest still applies.

Before going to court, please contact us. Most questions can be solved by email.
